The Sugar Rush Runaway Terms

This contract includes your model release, terms/conditions, and liability waiver for the Runaway! MODEL RELEASE. The CLIENT hereby grants to SUGAR RUSH PHOTO + VIDEO and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT may be included, for editorial, trade, facebook posts, web use, advertising, for profit, and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The CLIENT hereby releases SUGAR RUSH PHOTO + VIDEO and its legal representatives and assigns from all claims and liability relating to said photographs.

Copyright. Pictures are subject to copyright by SUGAR RUSH PHOTO + VIDEO. Infringement of copyright means no editing or changes made to the photos released to you. Copyright infringements will be prosecuted and fined. Upon delivery, limited copyright ownership of the resulting images will be shared with the CLIENT under the following conditions:

The digital negatives are the property of CLIENT for personal use only and for the purposes of the reproduction and giving of photographs to friends and relatives. CLIENT is given print release for any images 8×12 size or smaller, for printing at any quality printing studio (mpix.com, imaging depot, etc.), and any prints larger than an 8×12 are required to be printed through Sugar Rush Photo + Video through our pro lab. Wal-mart, Sam’s, and any mass-produced commercial grocery store will compromise the quality and color of your photos, and we are not held responsible.

The CLIENT must obtain written permission from and compensate SUGAR RUSH PHOTO + VIDEO prior to the CLIENT or its friends and relatives publishing or selling the photographs for profit. SUGAR RUSH PHOTO + VIDEO retains full ownership of photographs to use at their discretion.

We will send you an edited online gallery for your personal use with the ability to download and order prints! Images will be returned to you with in two weeks. We are so DANG EXCITED!

Release for Participation in Event or Activity
In exchange for participation in The Sugar Rush Runaway: A women’s weekend retreat in Bear Lake, including activities such as driving, hiking, swimming, kayaking, etc. (the “Activity”), organized by Lyndi Benson || Sugar Rush Photo _+ Video located at 2225 s 500 e , Salt Lake City, UT 84106 (“Releasee”), I hereby agree as follows:

I and anyone claiming on my behalf release and forever discharge Releasee and its affiliates, successors and assigns, officers, employees, representatives, partners, agents and anyone claiming through them (collectively, the “Released Parties”), in their individual and/or corporate capacities from causes of action of any nature and kind, known or unknown, which I may have against Releasee or any Released Parties arising out of or relating to any injury, loss or damage to person and property that may be sustained as a result of participation in the Activity (“Claims”).
I understand that participation in the Activity involves inherent risks, including risk of physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent paralysis and/or death, and I assume all related risks and voluntarily participate in the Activity, also including transportation to and from different parts of the Activity.
I agree to indemnify Releasee against any and all claims, actions, lawsuits, damages and judgments, including attorney’s fees, arising out of or relating to my participation in the Activity.
This Release for Participation in Event or Activity (“Release”) shall not be in any way construed as an admission by the Releasee that it has acted wrongfully with respect to me or any other person, that it admits liability or responsibility at any time for any purpose, or that I have any rights whatsoever against the Releasee.
This Release shall be binding upon the parties and their respective heirs, administrators, personal representatives, executors, successors and assigns. I have the authority to release the Claims and have not assigned or transferred any Claims to any other party. The provisions of this Release are severable.
If any provision is held to be invalid or unenforceable, it shall not affect the validity or enforceability of any other provision. This Release constitutes the entire agreement between the parties and supersedes any prior oral or written agreements or understandings between the parties concerning the subject matter of this Release. This Release may not be altered, amended or modified, except by a written document signed by both parties. The terms of this Release shall be governed by and construed in accordance with the laws of the State of Utah.
I have carefully read and fully understand all the provisions of this Release and am freely, knowingly and voluntarily entering into this Release.

Terms and Conditions for the Sugar Rush Runaway:
1: All payments to Lyndi Benson for your attendance are non-refundable. You may sell your ticket to someone else if you aren’t able to attend, but refunds will not be granted.
2: Your payment includes food and lodging for the duration of the workshop, minus one meal per day that you are responsible for purchasing when we go out to eat. Classes, gift bags, treats, etc. also included in your ticket. Pop-up shop purchases you make at the runaway are your responsibility to pay to the vendors out of pocket.
